If you're in an accident, even a bike accident, they should let you back when you heal up, regardless of how long it's been. Unless you're a dick at work and they don't like you.
But if you do lose your job JUST because you got in an accident, you can sue for wrongful termination, maybe get unemployment.
My sister got fired for saying "I hate you" to her boss and got unemployment for wrongful termination. She gets payed quite a bit every month. (Though this was mainly because the boss fired her on the spot instead of giving a warning).
Also, for completely different reasons, I am just as mad as you are right now, if not more mad.

Think about it:
Why would reserve a place for someone who might not work for you in an extended amount of time (Depending), when you COULD just fire them and hire somebody who is actually working?
If he's gone for a week, yeah, I can see him getting his job back. And maybe even a month. (That would be stretching it though.) But if it were me, I'd rather have somebody WORKING and GETTING ME MONEY than reserving a spot for somebody being injured for 3 or more weeks and NOT WORKING and NOT GETTING ME MONEY.
Well when you put it that way, you sound greedy. If you're boss and I'm injured employee, and you talked like that, the judge would more likely rule in favor of me, the one who is injured, rather than greedy sounding you.
Business is about making money. What you so naively refer to is greed is good business sense. An employer is responisble to more than one employee, and losing money hurts everyone. Judges know this, managers know this, and smart employees know this.
That being said: Magnum, I hope your employer can stand to lose you for a little while and still bring you back on.

Smiling actually is important if you're working a cash register or something where people see you a lot. Though I think most bosses just make them do poopty stuff (like clean bathrooms), then later let them do the other job again and tell them to smile more, or that's what I would do. If he's good with words he can win in court though, but it seriously is important to smile.
Oh yeah, and if he got fired his first day, either that won't matter because it was super early or something, or he could very easily get unemployment because of the lack of a warning. I don't know how a lot of this crap works, but my sister got unemployment mainly because the boss didn't give her a warning, she just said "OK, you're fired."

@ Jr. - This was a viable reason to get rid of me. I injured it outside of work, so it isn't protected. And it's not for the fact that I'm incompetent (I was the 'head busser' AKA I trained all the new people), it's the fact that I'm holding up a position when we're very busy.
