No dear, Fox is just a bad pilot. This his nothing to do with character confirmation.

I love this update... I've always wanted a trial feature in the Virtual Console, and this way I can try those games before wasting points.

By that logic, Classics Mario, Kirby, Samus, Pit, Link and Classic Ice Climbers have all been confirmed, as has the stage shown in each picture.
