If properly purchased, the rights to the site would belong with the new owner. Making a new site would get you sued.

But the site that was made in it's place was just one of those sites with the same name as another site except different ".com" thingy, and you can just call it something else.

No. That'd be considered a scam. If your intent was simply to migrate the userbase, and keep things the same, you'd be in serious poop if the purchaser caught on. You'd, at the very least, owe them a refund, as well as the site they purchased.

The last time I heard of him (atleast him being alive, cause he disappeared) was from JMV's forum Boyah or something.

Boyah iis Bassir's, Snorkel pays for the hosting if I recall correctly, and the domain is in JMV's name.
