Mega Man helped build Nintendo's status as a gaming company, Pac-Man is the first video game character, and Bomberman is accepted as Wario's rival. The latter two have already starred in Nintendo crossovers, and all three have video games on the DS and coming to the Wii. I'm not saying Siegfried can't be in Brawl, but he most definitely not has the shoe-in for final third party. Also, according to some recent interview (I forgot which one) Sakurai said they would be adding more third parties, which may or may not indicate more than 3 third parties.

And I thought Mario was Wario's rival! :P

In all seriousness though, Bombermas has some other good things going for him. He's been in quite a few games on Nintendo systems. Bomberman '93 is currently on the VC. Also don't forget that he's a Hudson character which helps with the Mario Party games.

Bomberman certainly has the credentials, especially Nintendo's relationship with Hudson. I think we could pretty much assume only third party mascots are getting in.
